Brent Eisenberg is a partner with DeHay & Elliston, LLP. He concentrates his practice on the defense of toxic tort, premises liability, asbestos and talc claims. He is licensed to practice law in both Illinois and Missouri. Mr. Eisenberg received the highest rating, “AV-Preeminent” from Martindale-Hubbell Law Directory, and was named by Illinois Super Lawyers as a “Rising Star” in litigation in 2017 and 2018. He was selected by America’s Top 100 LLC as one of the top 100 civil defense litigators practicing in Illinois, a recognition achieved by only half of one percent of litigators.

Legal Experience: Brent Eisenberg is licensed to practice in both Illinois and Missouri, and has more than eleven years of experience in preparing toxic tort, asbestos, silica, and talc cases to be trial-ready. Brent has second-chaired several jury trials in Illinois. He has also been retained as Missouri defense counsel for an automotive parts supplier sued in  toxic tort and asbestos litigation. Mr. Eisenberg is skilled in oral argument, and has successfully argued motions in Cook County, McLean County, Madison County, St. Clair County, St. Louis, Missouri and the Northern and Southern Districts of Illinois.

The following cases are examples of Mr. Eisenberg’s advocacy: Frank Greenwood v. Gary Railway Company, 10 CV 03885 (N.D. Ill. 2012); Robert Olson v. R.T. Vanderbilt Company, Inc., 10 L 260 (Winnebago County, IL, 2011) and Estate of Richard Meid v. 3M Company, et al, 11 L 9908 (Cook County, IL, 2013).

The Frank Greenwood case was a silicosis case involving a railroad worker who brought an FELA claim against his employer in the Northern District of Illinois as a result of his initial diagnosis of “usual interstitial pneumonia.” The plaintiff underwent a transplant of his left lung with present and future medical damages in excess of $860,000.00. Plaintiff’s attorney issued an initial settlement demand of $6,000,000.00. The case was resolved for a substantially reduced sum prior to verdict after successful rulings from Judge Rebecca Pallmeyer on our client’s motions in limine.

The Robert Olson case involved a career patternmaker who claimed he developed mesothelioma as a result of exposure to alleged asbestos-containing talc. Mr. Eisenberg prepared multiple motions in limine. As a result of defense rulings by the trial judge on most major evidentiary issues, the case settled for 10% of the plaintiff’s demand at the outset of jury selection.

Mr. Eisenberg also assisted with the Cook County, Illinois jury trial of the Estate of Richard Meid v. 3M Company, et al., a wrongful death case claiming exposure from our client’s distribution of Johns-Manville insulation products. After successful defense rulings on critical motions in limine and the delivery of opening statements to the jury, the case was settled for a substantial reduction from plaintiff’s unreasonable demand just prior to expert witnesses taking the stand.

Mr. Eisenberg has extensive experience in deposing expert witnesses over the past ten years. He has taken the lead in discovery deposition cross-examination of numerous plaintiffs’ experts in toxic tort and asbestos litigation.

Education: Brent Eisenberg earned his Juris Doctor from DePaul University College of Law, where he was awarded the CALI Award for Excellence in Advanced Trial Advocacy and named to the Dean’s List. In addition to his academic accomplishments, Mr. Eisenberg worked during law school as an extern for the Cook County States Attorney’s Office – Civil Actions Bureau and for the Honorable Ronald F. Bartkowicz, a Law Division Judge in the Circuit Court of Cook County. Prior to law school, Mr. Eisenberg received his Bachelor of Arts degree in Journalism with a minor in Business from Indiana University in 2005.

Admitted to Practice: Mr. Eisenberg is admitted to practice before the Illinois Supreme Court, the Supreme Court of Missouri, and the United States District Courts for the Northern District and Southern District of Illinois.
